Dividing assets upon the dissolution of either a marriage or civil partnership can often be a stressful and costly process. We appreciate this and will take the stress out of the process, as far as we are able to do so, whilst ensuring that the settlement reached is the best that can be achieved. Resolving financial matters can be achieved in one of two ways:
By consent
We understand that for many separating couples avoiding a court application can be preferable, if not essential. This is especially true if there are children involved. As such, we attempt to resolve matters amicably if it is possible to do so, promoting the use of family mediators to assist parties in appropriate cases to resolve financial matters as well as other forms of alternate dispute resolution such as family arbitration. However the matter is dealt with, we adopt a constructive approach to negotiations and offer sensible and pragmatic advice to clients throughout the process. If an amicable solution can be reached, we are specialists in drafting agreements into formal legal documents called ‘consent orders’, which, once sealed by the court, become legally-binding.
Applications to court for financial orders
Sometimes an application to court is unavoidable. Often court proceedings are required either to provide parties with a timetable to work towards or if one party will not provide financial disclosure. A court application may also be required if there is an issue of law that needs to be adjudicated upon. Whatever the reason, we have a breadth of experience at all levels to assist you in getting the right result. We will guide you throughout the process and advise you on issues that might arise, such as valuations and other expert reports.
